Item The horn of Africa and international terrorism : the predisposing operational environment of Somalia.(2008) Osondu, Chukudwi Solomon.; Okeke-Uzodike, Nwabufo Ikechukwu.A fundamental driving factor to contemporary international terrorism is the role of religion. Since the 1980s, there have been not only a rise in the number of Islamist terrorist incidents but also of a more globalized and intense dimension. The casualties have risen to unprecedented levels. Africa, and the Horn of Africa, in particular, has experienced its fair share of terrorist activities. For instance, in December 1980 terrorists sympathetic to the PLO bombed the Norfolk Hotel, owned by an Israeli, in Nairobi, Kenya, killing sixteen people and injuring over a hundred. The 7 August 1998 bombings of the US embassies in Nairobi, Kenya and Dar es Salaam, Tanzania, were more deadly: 240 Kenyans, 11 Tanzanians and 12 Americans died, with over 5,000 Kenyans and 86 Tanzanians injured. There was yet another terrorist attack on another Israeli-owned hotel in Mombassa and an attempt on a passenger plane on the runway at the Mombassa International Airport, Kenya. Both incidents happened in November 2002. Al-Qaeda claimed responsibility for the 1998 and 2002 attacks. With rising terrorism in the Horn of Africa and the reality of the Somali state failure, there is a growing concern that the Somali environment is supporting terrorist activities in the region. The activities of the al-Itihad al-Islamiya (AIAI) and later the Islamic Courts Union (ICU), the Somali Islamist fundamentalist organizations, with their feared international connections and the security implications, are of concern not only to the region but also to global security monitors. There is not much debate regarding the level of collapse of the Somali state and the possible security implications of the territory as a congenial terrorist safe haven. Most experts have presented Somalia as a clear example of a completely failed state. Rotberg (2002:131) describes Somalia as “the model of a collapsed state: a geographical expression only, with borders but with no effective way to exert authority within those borders". Jhazbhay (2003: 77) quoted Ali Mazrui as saying that "the situation in Somalia now is a culture of rules without rulers, a stateless society‟. Menkhaus (2003: 27) has singled out protracted and complete state collapse, protracted armed conflict and lawlessness as aptly representing the Somali situation. “Somalia‟s inability to pull together even the most minimalist fig-leaf of a central administration over the course of twelve years places the country in a class by itself.Item Preservation of, and access to, legal deposit materials at the Msunduzi Library, Pietermaritzburg.(2007) Nsibirwa, Zawedde Gulikomuseesa.; Hoskins, Ruth Geraldine Melonie.The study investigated preservation of, and access to, legal deposit materials at the Msunduzi Municipal Library. Constant access to legal deposit materials will depend on proper preservation methods from the time they are first produced. The focus was to identify how the different materials are preserved and stored, especially because every institution has unique needs, especially with regard to the climatic conditions of the area. The study also examined challenges faced by the depository, skills and knowledge of the depository staff about preventative preservation methods, resources for conservation and collection management strategies. The methods to help make materials accessible were established by examining the means and processes used. Methodological triangulation was used to look at the study in different ways and this included a questionnaire, interviews, observation and collection of graphic data. The units of analysis were the staff of the legal deposit department and the whole population was surveyed. In this study, quantitative and qualitative techniques were employed. The results of the self-administered question and observation schedule were analysed using SPSS. Data collected using the interview schedule was analysed qualitatively. The results of the study show that there are inadequate preservation activities and strategies for legal deposit materials at the Msunduzi Municipal Library. The legal deposit collection was at risk of being lost and inaccessible to present and future generations. This was mostly due to lack of preservation activities and strategies as a result of lack of knowledge in preservation, adequate funding, staff training, preservation policies, environmental control of stack rooms and the proper handling and storage of materials.Item The pen and the sword : philosophy of science in the writing of Girard Thibault.(2009) Dace, Peregrine.; Spurrett, David.This work is an investigation of the influence of academic philosophy on non-academics in the Early Modern period (the 16th and 17th centuries). The first chapter will use Craig’s Similarity Thesis to examine Early Modern philosophy in general, Philosophy of Science and Theology and how they interacted to elevate human reason to the level of divine certainty. The second chapter will draw on Dear’s description of the changing status of mathematics in academia in the Early Modern period. This second chapter will draw the importance and divine relevance of rationality as developed in the first chapter into the discussion to further explore the relationships between science, metaphysics, mathematics and the divine. The third and final chapter will examine one particular instance of the influence of these ideas on popular thought, specifically in Girard Thibault’s early 17th century treatise instructing the reader in swordsmanship, who uses the view of mathematics and the rational mind that is discussed in the preceding chapters to inform his theories of martial arts practice and pedagogy.Item Expectations, obligations and goals: an ethnographic study of two HIV/AIDS support groups south of Durban, South Africa.(2009) Hixon, Amy.; De la Porte, Susan.A focus on care and support for people living with HIV/AIDS throughout the world has become a key discussion in the general HIV/AIDS discourse. This thesis provides an in-depth analysis of two HIV/AIDS support groups operating in areas south of Durban, South Africa. In particular, the thesis presents the readers with a description of the 1) purpose of HIV/AIDS support groups, 2) main participants involved in HIV/AIDS support groups, and 3) an overview of how the two HIV/AIDS support groups under study operate. The grounded theory approach of this study led to the emergence of two themes crucial to the understanding of the HIV/AIDS support groups under study, the existence of widespread conflict, and a system of "negotiated" reciprocity within each support group. The thesis uses the framework of Victor Turner's social drama, and the anthropological theories of reciprocity, in order to analyze these concepts. This thesis reveals that each support group operates within an environment, in which a discrepancy of expectations, obligations, and goals amongst the support group participants exists. Additionally, the support group members and the sponsoring organization of both support groups have varying perceptions of the support group, both in its ideal and actual form. Finally, the thesis reveals the way in which each support group oscillates between a state of stability and conflict, and how conflict and negotiation, in turn, become inherent within, and synonymous with, everyday organisation and operation of the support groups.Item The state and the phallus: intersections of patriarchy and prejudice in the Jacob Zuma rape trial.(2009) Kakhobwe, Yumba Bernadette.; Meyiwa, Thenjiwe.The intention of this dissertation is to expose the gendered experiences of rape victims, based on the notion that while it should be the purpose of rape laws to protect victims of rape, in many circumstances the legal process results in disempowering experiences for victims, particularly women. Therefore, I suggest that the courtroom, a supposedly just space, is one which is laced with patriarchal undercurrents that work specifically against women. Rape is a complex and multi-faceted subject that is fast becoming an epidemic. In relation to HIV/AIDS and sexuality, the issue of rape certainly becomes compounded. Deconstructing the historical and cultural experiences of women is not only necessary in attempting to understand rape, but also the reasons why the justice system, which is dominantly a male domain, may still cling to patriarchal principles. One reason for the marginalization of rape victims may be the continued regard of women as second class citizens. The rape trial, in which Jacob Zuma was the alleged rapist, is a starting point, and by referring to this case, I intend to reveal and discuss weaknesses with regard to rape law within the South African context.Item The role of faith-based organisations in poverty alleviation in South Africa: challenging Putnam's conception.(2010) Day, Julie Vyvyan.; Grest, Jeremy.; Matisonn, Heidi Leigh.The number of South Africans that fall beneath “a commonly accepted poverty line” has risen from 17 million in 1996 to 23.5 million in 2008 (CDE, 2008: 6). The escalating poverty levels and the critical shortage of state-driven poverty alleviation programmes have led to the expansion of a space in which civil society organisations are attempting to address South Africa's development deficit. Given the potential and actual influence of such organisations, specifically faith-based organisations (FBOs), in poverty alleviation programmes, coupled with recent debates on the dark side of associational life, this research examines FBOs in terms of Putnam's conception of bonding and bridging social capital. Examining one particular FBO, in which no evidence of bonding social capital or exclusion is found, the research questions Putnam's rather narrow perception. However, strict gate keeping exercises on the part of the FBO, a lack of empirical data and the presence of complex social realities prevent a comprehensive evaluation of the FBO. Unable to prove whether this FBO provides a suitable model for the government to implement or whether the FBO is an appropriate candidate for government to partner with in the fight against poverty, it is proposed that a more wide-scale investigation of the programme and its participants, be conducted.Item A fragile and unsustained miracle : analysing the development potential of Zimbabwe's resettlement schemes, 1980-2000.(2009) Karumbidza, John Blessing.; Freund, William Mark.Black fanners' contribution and percentage share of the marketed agricultural produce (especially maize and cotton) increased dramatically following Zimbabwe's independence, especially between 1982 and 1987. Almost unanimously, observers in government and diplomatic circles spoke of this increase as 'phenomenal', attributing it to being a direct result of the government's efforts to increase agricultural production, and calling it a 'success story' and 'agrarian miracle'. This 'miracle' description was adopted by the state controlled and independent media, international donor and 'development' agencies, alike. By 1992, the levels of production achieved in the mid-1980s would not be repeated and this was blamed primarily on drought and the Economic Structural Adjustment Programme (ESAP) adopted by government in 1990. The direct impact of ESAP was the further reduction of government capacity and resources available to support the resettlement sector. By 2000, Zimbabwe was embroiled in a rural upheaval that threatened, reversed and undennined all the gains of the 1980s. The miracle discourse disappeared and in its place agro-pessimism took centre space. The land question rose to the fore amid a heightened outcry of landlessness, Communal Area congestion, poor access to institutional support and declining livelihoods and food security, among other things. This renewed rural crisis raised questions about what had happened to the miracle, exposed the run-down economy, and deepened undemocratic tendencies and a polarised political, economic and social space. The thesis proposed here is that the Zimbabwean government failed to take advantage and expand on the potential for an increased role of the rural sector in the cash economy. What emerged from closer scrutiny of the so-called agrarian transfonnation package for African agriculture was a poorly designed, uncoordinated and under funded quick fix to rural development that hardly moved beyond the mere transfer of land. Notwithstanding the participation of rural communities in the war of national liberation and the high profile nature of the land question during the Second Chimurenga, the post-colonial state apparatus - dominated by an urban nationalist petit bourgeoisie on the one hand, and the weak lobby of the beneficiaries of land refonn on the other - placed African agriculture into the back-seat of policy and political economic priorities. Evidence from Mayo Resettlement Scheme, the primary case study in this thesis, suggests that the argued institutional support and structural changes (basis of the miracle) were at best minimal, under-funded, crisis-averse, ad hoc and poorly coordinated, lacking the support of a concrete policy base, making the miracle at most fragile and in the final analysis unsustainable.Item An exploratory study of the non-kin models of care available to orphans and vulnerable children affected by HIV/AIDS in KwaZulu-Natal.(2010) McCarthy, Ashling Elizabeth.; De la Porte, Susan.Victims of HIV/AIDS are not only those who are infected with the disease, but also those who are affected by it; such as the children of infected parents and relatives, and indeed, all children living in communities in which the disease has reached epidemic proportions. As the number of orphaned and vulnerable children continues to rise unabated in South Africa the question remains as to who will look after these children once their parents, and relatives, have died. Research shows that the extended family continues to be the first line of support for such children; however, the dissolution of the extended family, due to HIV/AIDS, is also widely documented. The aim of this study is to explore two non-kin models of care which are available to orphaned and vulnerable children in KwaZulu-Natal; a transition home and a cluster foster home. The two organisations chosen for the study cater for children who are at different stages of childhood; one caters specifically for babies and toddlers, while the other caters for children and young adults between the ages of five and the early twenties. Both organisations emerged as a response to the HIV/AIDS epidemic which is profoundly evident in the areas in which the organisations are situated. The theory of social rupture thesis is utilised as it asserts that the extended family is reaching breaking point in terms of absorbing orphaned and vulnerable children, and therefore that it is slowly losing its ability to act as the first line of support against the disease. Based on the research and findings of this study, this hypothesis was found to be true, as was evident in the large (and increasing) numbers of children who can be found living in non-kin models of care around South Africa. An interesting phenomenon which was documented in both organisations was the re-emergence of the father figure in the home setting. South Africa is a country where the majority of children grow up without a traditional father figure and these two homes expressly include men in the lives of the children in order to highlight what they consider to be the necessary role of men within a family setting. This study explores the central themes which emerged during the research; that of the impact of shifting care-givers on the development of children, as well as the many socio-cultural issues which foster parents face while raising foster children.Item An exploration of the reasons surrounding Indian businesswomen's involvement in home-based business in Shallcross.(2008) Moodley, Lucille Claudia.; Ojong, Vivian Besem.The topic of this study is “An exploration of the reasons surrounding Indian businesswomen’s involvement in home-based businesses in Shallcross, Durban”. The objective of this study was to investigate some of the reasons why Indian women choose to venture into small business. This study also explored some of the history of the Indian people of Natal (now known as KwaZulu-Natal) and briefly touched on the past and present lives of Indian women in South Africa. The informants used in this study were Indian women who owned small home-based businesses. They all reside in Shallcross where they operate their businesses from their homes. Shallcross is situated in Durban, in the province of KwaZulu-Natal. Their businesses consisted of various types like hair salons, catering and gift shops. All interviews with the informants were informal in nature. Informal, unstructured yet indepth interviews and life histories were used in the study to collect data. Life histories were summarized to highlight the aims and results of the study. The literature reviewed for this study focused on issues on female entrepreneurship in South Africa. The most part of the literature review paid special attention to the changing role of Indian women, the nature of small businesses and their importance in South Africa’s developing economy, female motives for entrepreneurship and the future of female entrepreneurship. The literature review process has revealed a gap in the literature regarding Indian women involved in small business, but the literature also provided greater clarity and understanding of women entrepreneurship from both historically and contemporary perspectives.Item The importance of the African ethics of ubuntu and traditional African healing systems for Black South African women's health in the context of HIV and AIDS.(2007) Manda, Domoka Lucinda.This study takes the concept of ubuntu, which means humanness and applies it to healthcare issues in general, and women's health, in particular. Ubuntu is based on the reality of interdependence and relatedness. It is a philosophy or way of life that finds its roots and meaning in humanity. The values espoused in ubuntu emphasize caring, sharing, reciprocity, co-operation, compassion and empathy in recognition that for human beings to develop, flourish and reach their full potential, they need to conduct their relationships in a manner that promotes the well-being of others. There are indeed many unexplored dimensions of this area. Herein lies the rationale for this research which revolves largely around global consensus amongst academics, development practioners, civil society as well as, amongst others, global bodies, that public participation is part of the solution to SA's development challenges but acknowledgement that obstacles to constructive SA public participation with local government do exist; it are these (potentially unique) obstacles which this dissertation aims to identify and examine in order to become part of the solution for a better SA for all.Item Designing and assessing the feasibility of an active learning approach to the teaching of legal research.(2008) Kuhn, Rosemary Jean.This study set out to design and assess the feasibility of an active learning approach to a legal research module. The study was a case study of the second year undergraduate Legal Research Writing and Reasoning (LRWR) module on the Pietermaritzburg campus of the University of KwaZulu-Natal. This module forms part of the basic law degree curriculum. The author, a subject librarian at the University of KwaZulu-Natal, has been involved with this module for several years. The module is situated within the general lecture timetable and the lecture format is unsuitable for a module such as this one that requires practical work. Students of law need to have a sound knowledge of the published legal literature because of the particular nature of the role of legal literature in the study of law, the vast array of literature available and the complex presentation of information within the sources of law. Students of law also need to be able to read, understand and apply the law to given situations. Legal education in South Africa has undergone considerable changes since 1994 alongside those in higher education generally. Since 2001 the LLB degree has become a four year undergraduate degree replacing the old three year undergraduate plus two year post-graduate qualification. New national qualification requirements emphasise a range of skills such as problem-solving, numeracy, computer skills, writing, and finding and using information. This is partly as a means of redressing the differential preparedness of students for university, a legacy of schooling of variant quality that was a feature of Apartheid governance prior to 1994. Thus students are having to complete the law degree in a shortened time period; do not have the benefit of an undergraduate degree before embarking on the law degree, and need to develop competencies in a range of skills and knowledge adjacent to substantive law modules. Information literacy is a process, an active problem-solving process and an amalgam of skills and knowledge concerned with identifying an information need, finding, evaluating and using a range of information to answer that need in appropriate ways. The problem-solving nature of the study of law, the new national requirements for a legal education and the characteristics of information literacy suggest that these three elements could be usefully combined in an active learning and teaching process to enable students of law to develop a holistic approach to learning skills and knowledge of legal research, writing and reasoning in the South African context. The research questions that arose in response to the research problem required an investigation into current research and writing with regard to information literacy, legal education, learning, teaching and assessment and whether an active learning approach was feasible with a large class size of approximately 130 students. The situation in South African law faculties as regards legal research teaching and learning needed to be considered to situate the current study in the broader national context. The literature review enabled the development of a theoretical framework for the LRWR module that took cognisance of a range of national, institutional and classroom climates, aims, objectives, outcomes and content for modules, the study of law, characteristics of learners and factors affecting their performance, teaching strategies, instructional design, assessment and information literacy. The module itself was designed in terms of a problem-solving situation which encompassed a range of integrated skills in order to manage the problem. An active learning approach was adopted in the form of group and class discussion, with a range of scaffolded written, oral and practical exercises and assignments to help students investigate the problem scenario from a number of perspectives. The design of the module required data in the form of demographic characteristics and work habits of the students in the class inclusive of learning styles which were acquired through the application of a questionnaire and learning styles inventory. Knowledge and skills with respect to module content were measured in terms of a pre- and post-test. A reflection exercise and focus groups provided evidence about how the students responded to the overall design of the module and in particular the active learning approach. The data collected and analysed suggested that the integration of information literacy, problem-solving processes with respect to the study of law and active learning was feasible and successful in this large class situation to varying degrees. The students in the module had expanded their repertoire of skills and knowledge, had appreciated the relationship between research, writing, reasoning and discussion and enjoyed the active learning approach. The contribution this research makes is with regard to the character, design and implementation of information literacy programmes in academic libraries in South Africa in particular, given the dearth of published practitioner research in this country. The research has also provided a comprehensive theoretical and practical framework for developing an information literacy programme within the changing South African legal education context. The research in this specific context usefully provides a baseline from which to develop and promote information literacy as a critical approach within the study of law.Item Information and communication technologies and sustainable livelihoods : a case of selected rural areas of Tanzania(2008) Chilimo, Wanyenda Leonard.; Ngulube, Patrick.Information and communication technologies (ICTs) have, in the recent past, attracted enormous attention as important tools for socio-economic development. However, the role of ICTs in fostering development and addressing the needs of the poor, especially in developing countries, has become the subject of a heated debate. This contestation is due to the high failure rate of the ICTs for development projects and a widening gap between the expectations of what ICTs can possibly do and the experiential reality of how these technologies are actually being used. More often than not ICTs have been regarded as a panacea or a „magic bullet‟ that will solve all development problems, with ill-conceived expectations of how they would be used. This study examined the relationship between ICTs and sustainable livelihoods in selected rural areas of Tanzania. The aim was to investigate how and for what purposes ICTs are used by people in the selected rural areas of Tanzania and to study the effect that ICTs have had on the various aspects of their livelihoods. A combination of the sustainable livelihoods framework and other ICTs for development models formed the theoretical foundation of the study. The investigation was carried out using ICT services provided by the telecentres and mobile phone services. The study was conducted in four rural districts in Tanzania which have telecentres. It used a multi-case study research design. A mixed paradigm methodology was adopted and the qualitative research was used as a dominant paradigm. Data was collected through structured interview protocols administered to 203 users and non-users of ICTs in communities surrounding the telecentres. Semi-structured interview protocols were administered to four managers of the telecentres. In addition, eight focus group discussions were conducted in communities surrounding the telecentres. An observation checklist was used to verify data obtained from managers, users and non-users of the telecentres. The study administered semi-structured interview protocols to officers from the ministry responsible for ICTs in Tanzania, that is the Ministry of Infrastructure Development (MoID), The Tanzania Communication and Regulatory Authority (TCRA) and a national research institution (The Commission for Science and Technology- COSTECH). The findings of the study indicated that, contrary to the use of mobile phones, which was characterised by greater uniformity across socio-economic groups and gender, telecentre users in the researched areas were generally young. The majority were males with higher levels of education. It was found that telecentres management have failed to take into consideration the appalling conditions of the extremely poor and disadvantaged individuals in their provision of ICT services to the community. The study established that the urban rural digital divide still exists and is still a reality in the areas reviewed, despite some efforts that are under way to bring ICTs to those communities. Old ICTs such as radio and television are not universally available. It was observed that inadequate road infrastructure makes it difficult for farmers to transport their produce to markets outside the districts, even in cases where farmers are provided with information on the availability of those markets. Inadequate electricity supply hinders large-scale uptake of ICTs in rural areas. The findings show that telecentres managers were not aware of the information needs of the communities they serve and therefore they were not in a position to meet such information needs. Due to personnel‟s inadequate skills and capacity the Ministry of Infrastructure Development did not play its policy-making function effectively. This problem, coupled with delayed implementation of important policy objectives such as the universal access policy and even the national ICT policy itself, affects the development of the ICT sector in rural areas of Tanzania. The findings further show that while the necessary conditions for access exist in all the telecentres involved in the study, sufficient conditions for access are still lacking, especially with regard to skills, awareness and affordability. On the relationship between ICT and rural livelihoods the findings of the study show that while ICTs may not fully support and sustain socio-economic development in poor communities, the impact of these technologies extends to various aspects of the livelihoods of the rural people. Economically, these technologies lead to better earnings and savings. Socially, they help in community interaction and knowledge-sharing, better follow-up for remittances and creation of savings and credit co-operative societies. In relation to human capital, the technologies‟ implications extend to ICT literacy, improved farming techniques and better access to information on new cash crops. The use of ICTs in rural areas is still faced with many barriers. These range from affordability to language problems and the lack of basic infrastructure such as electricity. Language was particularly found to be a substantial barrier to effective use and application of ICTs. The study recommends that telecentre managers should re-design programmes with the aim of bringing the under-represented groups such as farmers back to the centre of their projects, rather than treating them as passive receivers of ICT services. On the issue of mobile phones, there is a need to develop services that are nuanced towards the real needs of the rural people and incorporate them into the mobile technology. The study recommends that universal access policies should involve old ICTs such as radio and television, or people in the rural areas, who have fewer resources, will eventually pay too much for basic communication services, as in the case of satellite television and radio. Capacity-building is important, not only in the regulatory authorities, but also in the ministries responsible for ICTs and other institutions involved with ICTs, so as to provide effective national ICT leadership. The study recommends that managers of telecentres learn about the different aspects of access, in order for them to go beyond the provision of physical access to ICTs. Continuous improvement and renewal of telecentre services is necessary to ensure survival of the telecentres. Collaboration of the telecentres and other organisations, such as academic institutions, is needed to create content both for the telecentres and the community radios. Telecentres and other information systems developed or adopted to serve the people must meet the needs of the people intended to be served. Post-Colonial Africa is considered the birthplace of the modern mercenary and historically features prominently as a testament to the potential for immoral privately sponsored military activities within unstable states. Moreover, it is a rich market that the Private Military Industry is increasingly turning its attention to, albeit focussing on support functions for now, but a massive industry with a competitive and poorly regulated market environment will invariably begin to explore different avenues as competition grows. With market diversification grows the ethical risk of abuse. At the same time, peacekeeping efforts across the continent are hampered by numerous factors, not least of all a chronic lack of trained personnel. Could the legal and political legitimacy, not to mention the sustainable market environment sought by the PMI potentially exist in multilaterally sanctioned, privatised peacekeeping and peace support operations in Africa? Can the ethical challenges of mercenarism be suspended or even bypassed for the sake of expedient intervention in potential genocides, or be perhaps pragmatically accepted as an inevitable development that should be embraced rather than condemned, for strategic security reasons? Can the ethical condemnation of the proposed means of peace support be overridden by the potential ends generated by such a move? Is the world ready for privatised peacekeepers? This dissertation explores the ethical background to the privatisation of military operations and how these foreign policy trends and social perceptions of control of force impact on the notion of privatised peacekeeping, particularly in the context of operations in Africa. It investigates the philosophical implications of privatised peacekeeping by way of a constrained pragmatic form of consequentialist evaluation that warns against reckless expediency. Ultimately, this dissertation offers a more philosophically suitable argument to justify and control this seemingly inevitable next step in the trend of privatisation of force.Item A conceptual exploration of academic freedom and institutional autonomy in South African higher education : postmodernism, globalisation and quality assurance.(2008) Webbstock, Denyse Jean.This thesis proposes a conceptual framework for the discussion of concepts of academic freedom and institutional autonomy in a South African higher education context. A four-cell matrix is presented at the start of the thesis that distinguishes four types of understandings of these concepts. Having discussed these concepts-in-use in different contexts, the grid is used as a framework to explicate local debates on academic freedom and institutional autonomy. Beyond the conceptual exploration, the thesis traces a variety of broader debates in higher education in an attempt to add a richness to the South African conversations relating to academic freedom and institutional autonomy. Postmodernism and its implications for higher education in South Africa is explored, as is the more recent phenomenon (or ideology) of globalisation. Finally, the advent of external quality assurance in South Africa is considered and its role in changing perceptions of academic work and academic identity through the potential circumscribing of the academic domain is explored. My hope is that this thesis will contribute to a broadening and deepening of the current South African debates, and at the same time, offer a uniquely South African perspective on global conversations on academic freedom and institutional autonomy.Item Should groups in liberal democracies have special rights to limit speech that is offensive to their culture or religion?(2008) Goga, Khalil.; Piper, Laurence.My topic is an analysis of the various theories of multiculturalism and how they would respond to controversial issues concerning freedom of speech with regard to religious sensitivities. While Western nations have often concentrated on 'nation building', or the integration of citizens into public institutions, there has been the emerging trend of minority rights and 'multiculturalism' (Kymlicka, 2001, pp. 2-3). Groups with diverse interests and political agendas are resisting assimilation into wider society and are struggling for acceptence, respect and public affirmation of their differences (Parekh, 2000, p. 1). While the nation state has not become obselete, many of its traditional functions have lost their relevance and value and we therefore need to reconceptualize its nature and role (Parekh, 2000, pp. 193-194). Many nations have a new found interest in multicultural policies and Australia has declared itself multicultural in the early 1970's as did Canada; and the debate around multicultural policies has raged on in Britain, Germany and Israel since the 1960's (Parekh, 2000, p. 5). In Kymlicka's view, public opinion has shifted from seeing minority rights as a pragmatic compromise to a matter of fundamental justice (Kymlicka, 2001, p. 6). One controversy that multiculturalist policies have raised is issues of tolerance of cultural difference, including group rights. This is evident on a daily basis, from the storm around Muslim girls wearing headscarves in France, to the debate surrounding the use of French as a first language in Quebec; multiculturalism has been asked, what should be tolerated? In my dissertation I will look at the controversial topic of freedom of speech within liberal democratic systems. Freedom of speech is an integral part of a democratic system, and in democratic systems discussion is often cited as a means of reaching consensus and compromise. Free speech is also intended to explore new ways of thinking and to criticize ways of thinking and living. The difficulty comes when there are certain topics, such as the lampooning of Islam and the Prophet and denying the Holocaust, which are deemed to be off limits by certain groups. Different liberal philosophies however have differing views on what the limits of free speech are. I will be looking into these philosophies and whether the limits they set apply to the Danish cartoon controversy and to the David Irving case of Holocaust denialism. There are three broad theories of how liberal systems ought to deal with the demands of a plural society. These are 'classical liberalism', 'liberal nationalism' and 'multiculturalism'. In broad terms, classical liberal theory is intolerant of special group rights, liberal-nationalism affirms certain kinds of group rights within a liberal framework, and multiculturalism asserts the equality of cultures, and questions the primacy of liberalism. The question that I will be answering is how these theories deal with group rights when those groups ask for the limiting of speech that is deemed offensive to group culture or religion. In a more global society, different cultural and religious groups have differing levels of tolerance toward certain kinds of speech. Certain groups value freedom of speech with very few constraints, whilst others believe that that some speech is harmful and disrespectful to their culture or religion. Questions about the viability of these different cultural and religious groups co-existing have been highlighted by recent events. The two cases to be explored in my analysis will be, firstly, the outcry following the publication of cartoons of the Prophet Muhammed in Denmark. Many of these cartoons were seen to be derogatory to Muslims and the depiction of the Prophet is also not allowed in many Islamic traditions. Much of Danish society felt that although these cartoons were offensive and in bad taste, they had to protect their right to freedom even though it may be offensive to others. This pits the Islamic culture against that of the Danish 'liberal' culture and asks the question of whether 'liberal' culture or 'multiculturalism' can assure religious tolerance? My second example is the controversial case involving the historian David Irving and his questioning of the Holocaust. This questioning led to his imprisonment in Austria for the crimes of Holocaust denial. This case involves someone expressing his freedom of speech, yet many liberal-democratic countries have laws expressly prohibiting this kind of Holocaust denial. The reasoning behind such laws is to protect the sentiments of Jewish community and the suffering they endured under the Holocaust. In both cases, the interests of religious groups are invoked as being sufficiently harmed, and the liberal right to free speech should therefore be limited. Hence the thesis looks to explore religious tolerance available in classical liberal, liberal-nationalist and multiculturalist systems at a theoretical level. I will also argue that certain kinds and manner of speech, such as speech that lampoons and offends group sensibilities, should be limited in certain cases and that liberal-nationalism provides the most fair way of adjudicating disputes.Item Can we be particularists about environmental ethics? : assessing the theory of moral particularism and its practical application in applied environmental ethics.(2008) Toerien, Karyn Gurney.; Roberts, Deborah.; Farland, Douglas.Moral judgments have tended to be made through the application of certain moral principles and it seems we think we need principles in order to make sound moral judgments. However, the theory of moral particularism, as put forward by Jonathan Dancy (2004), calls this into question and challenges the traditional principled approaches to moral reasoning. This challenge naturally began a debate between those who adhere to principled accounts of moral rationality, and those who advocate a particularist approach. The aim of this thesis is thus to assess the theory of moral particularism as recently put forward by Jonathan Dancy. In pursuing this project I initially set up a survey of the field of environmental ethics within which to explore traditional approaches to applied ethics. This survey suggests that applied ethical problems have traditionally been solved using various principled approaches and if we are inclined to take the particularist challenge seriously, this suggests a philosophical conundrum. On the one hand, increasingly important and pressing applied environmental ethical concerns suggest there is a practical need for ethical principles, whilst on the other hand, the particularist claim is that we do not need principles in order to make sound moral judgments. The survey of environmental ethics then establishes the first side of the philosophical conundrum. I then move to explore the second side of the conundrum; the theory of moral particularism, looking at why the challenge it presents to traditional principled approaches needs to be taken seriously. I then move to explore theoretical challenges to moral particularism; this is done to establish the current state of the theoretical debate between the particularist and the generalist. I conclude from this that the theoretical debate between the two has currently reached a stalemate; it is, at present, simply not clear which account is correct. As the main goal of this study is to evaluate particularism, this apparent stalemate led me to explore certain practical challenges to particularist theory as a means of advancing the debate. As particularism is a theory that challenges our traditional conception of how to make moral judgments, there will be important implications for applied ethics if particularism turns out to be correct, and 1 thus finally apply particularism to a practical environmental problem in order to assess the validity of practical challenges to particularism. In order to do this, a particularist ethic is applied to the question of whether or not to allow mining in Kakadu National Park in Australia. This provides a means of seeing what an applied particularist ethic could look like, as well as providing something of an answer to the practical challenge to particularism and achieving the goal of evaluating it within the applied context of environmental ethics.Item An investigation into the meaningfulness of moral language.(2007) Goodwin, Carin.No abstract available.
